Terms & Conditions

1. Eligibility

You must be legally capable of entering into a binding agreement to independently create and manage a Kompete account.

Because Kompete may be used by youth athletes, individuals below the applicable age of legal consent may use the Services where permitted through:

• A parent or legal guardian
• An authorized coach
• A team
• A school
• An academy
• A club
• A sports organization
• An authorized testing provider
• Another organization legally permitted to act on their behalf

Where parental or guardian consent is required by law, the parent or guardian must provide the necessary consent before the youth athlete uses applicable Services.

If you are a parent or guardian who creates, approves, or manages an account for a minor, you accept responsibility for that minor's use of the Services and agree to these Terms on their behalf to the extent permitted by law.

Organizations using Kompete for youth athletes are responsible for obtaining any permissions, authorizations, or consents legally required for information they provide to Kompete.

2. Account Registration

Certain Kompete Services require an account.

When creating or maintaining an account, you agree to provide information that is:

• Accurate
• Complete
• Current
• Truthful

You must not:

• Impersonate another person
• Create an account using false information
• Misrepresent your age, identity, organization, qualifications, or authority
• Create an athlete account without appropriate authorization
• Access another user's account without permission

You are responsible for updating account information when necessary.

We may request additional information to verify your identity, age, organizational role, testing credentials, or authority to access an athlete's information.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to:

• Use reasonable security measures
• Keep passwords confidential
• Avoid sharing login credentials with unauthorized persons
• Notify Kompete promptly if you believe your account has been compromised
• Log out of shared or publicly accessible devices when appropriate

Organizations are responsible for managing access permissions for their coaches, administrators, employees, contractors, and other authorized users.

Kompete may temporarily restrict, suspend, or disable an account if we reasonably believe that it has been compromised or is being used in violation of these Terms.

4. Kompete Services

Kompete provides technology and services relating to athlete testing, performance measurement, analytics, development, training, benchmarking, reporting, recruiting, and related activities.

Depending on your subscription, organization, location, equipment, or account type, Services may include:

• Athlete profiles
• Athlete rosters
• Performance testing
• Testing-event management
• Speed and agility measurement
• Jump and power testing
• Testing-equipment integration
• Performance reports
• Benchmark comparisons
• Historical performance tracking
• Team and group comparisons
• Athlete development tools
• Training recommendations
• Goal setting
• Workout programming
• Workout assignments
• Remote training
• Performance dashboards
• Recruiting profiles
• Verified or shareable performance metrics
• Scout or recruiting tools
• Coach dashboards
• Organization management
• Analytics
• AI-powered insights
• Connected testing equipment
• Partner and testing-provider services

Features may differ between plans and may be modified over time.

Kompete does not guarantee that every feature will always be available in every country, sport, organization, subscription plan, device, or platform.

5. Athlete Testing and Performance Results

Kompete may be used to collect, store, analyze, display, and compare athlete testing results.

Testing results may include measurements relating to areas such as:

• Speed
• Acceleration
• Agility
• Power
• Jump performance
• Strength
• Conditioning
• Reaction
• Movement
• Other athletic-performance metrics

Results may be captured using Kompete equipment, compatible equipment, authorized testing systems, testing providers, manual entry, or approved integrations.

Testing Conditions

Athletic performance can be affected by numerous factors, including:

• Testing environment
• Equipment setup
• Athlete effort
• Surface conditions
• Weather
• Fatigue
• Injury
• Testing technique
• Operator technique
• Calibration
• Equipment condition
• Differences in testing protocols

Accordingly, no testing result should be considered an absolute or permanent measure of an athlete's capability.

Accuracy

Kompete seeks to provide reliable systems and analytics but does not guarantee that every measurement, calculation, benchmark, ranking, report, or test result will be error-free.

Users responsible for administering tests must follow applicable equipment instructions, testing protocols, and safety procedures.

If you believe a result is incorrect, you should notify the appropriate testing provider, coach, organization, or Kompete as applicable.

6. Physical Activity and Assumption of Risk

Athletic testing, training, workouts, drills, exercises, and sporting activities involve inherent physical risks.

These risks may include:

• Muscle strains
• Sprains
• Falls
• Collisions
• Fatigue
• Dehydration
• Cardiovascular stress
• Aggravation of existing injuries
• Serious bodily injury
• Other risks associated with physical exercise and sporting activity

Before participating in testing or training, users are responsible for determining whether they are physically capable of safely participating.

You should stop exercising or testing and seek appropriate professional assistance if you experience symptoms such as severe pain, dizziness, faintness, breathing difficulty, chest discomfort, or other concerning symptoms.

Where appropriate, users should consult a qualified medical or healthcare professional before beginning a new training program or participating in demanding physical testing.

To the fullest extent permitted by law, participation in athletic testing or physical activity is undertaken at the participant's own risk.

7. No Medical Advice

Kompete is a sports performance and athlete-development platform.

Kompete does not provide medical diagnosis, medical treatment, physical therapy, emergency medical services, or professional healthcare advice.

Information made available through Kompete, including:

• Performance scores
• Training recommendations
• Development suggestions
• Workout content
• AI-generated insights
• Benchmark comparisons
• Reports

is provided for athletic performance, informational, educational, or training purposes.

Such information should not replace advice from a qualified physician, physiotherapist, athletic therapist, trainer, psychologist, nutritionist, or other appropriately qualified professional.

Never disregard professional medical advice because of information provided through Kompete.

8. Analytics, AI and Automated Recommendations

Kompete may use algorithms, statistical systems, artificial intelligence, machine learning, automated analysis, or similar technologies to generate insights based on athlete information.

These features may help:

• Summarize performance
• Identify trends
• Compare benchmark information
• Highlight potential strengths
• Identify development opportunities
• Recommend areas of focus
• Suggest training activities
• Assist coaches in interpreting results

Automated outputs are estimates and recommendations. They are not guarantees.

Kompete does not guarantee that:

• A recommendation will improve athletic performance
• An athlete will reach a particular performance level
• A benchmark predicts future success
• An athlete will receive a scholarship
• An athlete will be recruited
• A scout or organization will select an athlete
• A particular training program will produce a specific outcome
• AI-generated information will always be complete or accurate

Users should apply appropriate human judgment when relying on automated insights.

Coaches and organizations remain responsible for professional decisions they make concerning athletes under their supervision.

9. Coaches, Teams and Organizations

Coaches, academies, schools, clubs, teams, testing businesses, and sports organizations may use Kompete to manage athletes and performance information.

If you use Kompete on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Organizations are responsible for:

• Maintaining appropriate account permissions
• Ensuring only authorized persons access athlete information
• Obtaining required athlete or parental permissions
• Complying with applicable child-protection requirements
• Complying with applicable privacy laws
• Correctly associating athlete records
• Maintaining appropriate testing practices
• Using athlete information only for legitimate purposes
• Removing access when coaches or administrators leave the organization

Organizations must not use Kompete data in an unlawful, discriminatory, exploitative, or misleading manner.

10. Parents and Guardians

Parents or guardians may have access to information concerning youth athletes associated with their accounts.

Parents and guardians are responsible for:

• Providing accurate information
• Supervising use of the Services where appropriate
• Reviewing relevant training and testing activities
• Assessing whether participation is appropriate for the athlete
• Maintaining account security
• Providing legally required consent

Nothing within Kompete removes the responsibility of a parent, guardian, coach, or organization to appropriately supervise a youth athlete.

11. Recruiting Profiles and Athlete Exposure

Certain Kompete Services may allow athletes to create recruiting profiles or share verified performance information.

Depending on available functionality, a profile may include:

• Athlete name
• Sport
• Position
• Team or organization
• Graduation year
• Performance measurements
• Benchmark comparisons
• Rankings
• Testing verification
• Achievements
• Development information
• Other recruiting information selected for sharing

You are responsible for reviewing information before making it available through recruiting or sharing features.

No Recruiting Guarantee

Kompete provides technology that may help athletes communicate performance information.

Kompete does not guarantee:

• Recruitment
• Scholarships
• Team selection
• Professional contracts
• Scout interest
• University or college admission
• Athletic eligibility
• Placement with any organization

Recruiting decisions are made independently by third parties.

12. Scouts, Recruiters and Talent Evaluation

Where Kompete provides scout, recruiter, or talent-evaluation functionality, users accessing those features agree to use athlete information only for legitimate sporting, recruiting, evaluation, or development purposes.

Users must not:

• Harvest athlete information for unrelated marketing
• Sell athlete information
• Contact minors in an inappropriate manner
• Misrepresent their professional identity
• Use information for unlawful discrimination
• Scrape or export information without authorization
• Circumvent privacy settings
• Use athlete information for unrelated commercial purposes

Kompete may suspend access to recruiting or scouting functionality where misuse is suspected.

13. Testing Partners and Events

Kompete Services may be provided in connection with authorized testing events, certified testing partners, performance centers, sports organizations, or other operators.

Testing partners may conduct testing using Kompete technology.

Unless specifically stated otherwise in a separate agreement, the entity conducting an event is responsible for operational aspects under its control, which may include:

• Event scheduling
• Venue safety
• Athlete supervision
• Staff
• Local permissions
• Emergency procedures
• Testing setup
• Following appropriate testing protocols

Kompete may provide technology, equipment, software, training, or support without controlling every aspect of an independently operated event.

Specific commercial relationships with certified partners, territory operators, or licensees may be governed by separate agreements.

14. Testing Equipment and Hardware

Kompete or authorized partners may provide or sell athletic testing equipment and related hardware.

Hardware may be subject to separate:

• Purchase terms
• Warranty conditions
• Installation instructions
• Technical requirements
• Maintenance requirements
• Return policies
• Shipping policies
• License terms

Users must operate equipment according to provided instructions.

You must not:

• Deliberately damage equipment
• Disable safety mechanisms
• Tamper with hardware
• Modify firmware without authorization
• Reverse engineer protected systems except where legally permitted
• Use equipment in unsafe conditions
• Misrepresent testing results
• Manipulate testing systems to produce false results

Kompete is not responsible for inaccurate results caused by improper installation, misuse, unauthorized modification, incorrect configuration, damaged equipment, or failure to follow instructions.

15. Subscriptions and Paid Services

Certain Kompete features require payment.

Subscription offerings may include different levels of features, limits, functionality, users, athletes, storage, or organizational capabilities.

Prices, billing frequency, and included features will be shown at the time of purchase.

Recurring Subscriptions

Where you purchase a recurring subscription, you authorize the applicable payment provider to charge the payment method associated with your account at the applicable billing interval until cancellation.

Subscriptions may renew automatically where disclosed at purchase and permitted by law.

Billing

You are responsible for:

• Providing valid billing information
• Maintaining a valid payment method
• Paying applicable charges
• Paying applicable taxes
• Reviewing subscription details before purchase

Pricing Changes

Kompete may change subscription pricing.

Where required, we will provide advance notice of changes affecting an existing recurring subscription.

Cancellation

You may cancel a subscription using the applicable account, billing, app-store, or support process.

Unless otherwise required by law or stated at purchase, cancellation generally prevents future renewals rather than retroactively cancelling the current paid billing period.

Refunds

Refund eligibility is subject to:

• App-store rules
• Other policies disclosed at purchase

Purchases processed through an app store or third-party provider may be subject to that provider's refund procedures.

16. Organization and Enterprise Agreements

Teams, academies, testing organizations, businesses, licensees, and other commercial customers may enter into separate agreements with Kompete.

Those agreements may address matters such as:

• Subscription fees
• Athlete limits
• Hardware
• Implementation
• Service levels
• Territory rights
• Testing operations
• Data processing
• Support
• Intellectual property
• Confidentiality
• Payment terms

Where a valid written commercial agreement conflicts with these Terms, that agreement controls for the subject matter it specifically addresses.

17. User Content

Users may be permitted to submit, upload, create, or store content including:

• Profile information
• Photographs
• Videos
• Training information
• Athlete information
• Notes
• Reports
• Workout information
• Comments
• Documents
• Organization information
• Other material

Collectively, this is "User Content."

You retain ownership of User Content that you legally own.

You grant Kompete a non-exclusive, worldwide, royalty-free license to host, reproduce, process, transmit, display, format, and technically modify User Content as reasonably necessary to:

• Operate the Services
• Provide requested functionality
• Generate reports
• Process analytics
• Make authorized information available to permitted users
• Maintain and improve the Services
• Back up and secure information

This license does not transfer ownership of your User Content to Kompete.

You represent that you have the necessary rights, permissions, and authorizations to provide User Content to Kompete.

18. Athlete Data Submitted by Organizations

Where an organization submits athlete information, that organization represents that it has a lawful basis and appropriate authorization to provide such information.

Organizations must not knowingly:

• Create duplicate athlete identities for improper purposes
• Associate test results with the wrong athlete
• Falsify testing results
• Manipulate benchmark information
• Upload information they have no authority to use
• Share athlete information with unauthorized persons

Kompete may investigate suspected misuse or inaccurate records.

19. Intellectual Property

Except for User Content and third-party material, Kompete and its licensors own all rights, title, and interest in the Services.

This includes, where applicable:

• Software
• Source code
• Applications
• Interfaces
• Designs
• Graphics
• Logos
• Branding
• Databases
• Reports and report structures
• Algorithms
• Testing methodologies
• Analytics systems
• Documentation
• Training content
• Videos
• Written content
• Equipment designs
• Benchmarking systems
• Proprietary processes

Subject to these Terms, Kompete grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for their intended purpose.

No ownership rights are transferred to you.

20. Acceptable Use

You agree to use Kompete lawfully and responsibly.

You must not:

• Violate applicable laws
• Access another person's account without authorization
• Falsify athlete information
• Manipulate test results
• Create fraudulent performance records
• Impersonate athletes, coaches, scouts, or organizations
• Harass, threaten, exploit, or harm another user
• Inappropriately contact youth athletes
• Upload malicious code
• Attempt unauthorized system access
• Bypass security controls
• Interfere with service availability
• Probe or test system vulnerabilities without authorization
• Use bots or automated systems to abuse the Services
• Scrape athlete or organization information
• Harvest contact information
• Reverse engineer Kompete systems except where legally permitted
• Copy proprietary datasets or benchmarks
• Resell account access without authorization
• Misuse Kompete branding
• Use information for unlawful surveillance
• Upload unlawful, defamatory, threatening, or infringing material
• Violate intellectual-property rights
• Use Kompete to facilitate fraud
• Use Kompete information for unauthorized marketing

We may investigate suspected violations.

21. Benchmark Data

Kompete may provide benchmark statistics designed to help users understand performance relative to selected datasets.

Benchmark information may differ based on characteristics such as:

• Sport
• Position
• Age group
• Competition level
• Sex or category where appropriate and lawfully used
• Geography
• Testing protocol
• Dataset size
• Other relevant criteria

Benchmark information is intended to provide context.

It should not be treated as a definitive assessment of an athlete's potential, ability, value, health, or future success.

Benchmark datasets may evolve as additional information becomes available.

22. Third-Party Services

Kompete may integrate with third-party products or services, including:

• Payment processors
• Authentication providers
• Cloud infrastructure
• Analytics platforms
• Equipment providers
• Communication services
• App stores
• Video providers
• Athletic systems
• Other integrations

Third-party services are governed by their own terms and policies.

Kompete is not responsible for third-party products or services that it does not control.

Your use of those products may require acceptance of additional terms.

23. Third-Party Links

The Services may contain links to external websites, applications, content, or resources.

Kompete does not control those third parties and does not guarantee:

• Availability
• Accuracy
• Security
• Content
• Products
• Services
• Privacy practices

Accessing third-party resources is at your discretion.

24. Communications

By maintaining a Kompete account, you agree that we may send operational communications reasonably necessary to provide the Services.

These may include:

• Account notices
• Security alerts
• Testing notifications
• Report notifications
• Subscription notices
• Payment information
• Service changes
• Administrative messages

Where permitted and with required consent, we may also send promotional communications.

You may opt out of promotional messages using available unsubscribe controls.

You may not be able to opt out of communications necessary to maintain your account or provide purchased Services.

25. Suspension and Termination

You may stop using Kompete at any time.

Where available, you may request deletion or closure of your account subject to applicable retention requirements and organizational relationships.

Kompete may restrict, suspend, or terminate access where we reasonably determine that:

• These Terms have been violated
• The account presents a security risk
• Fraud is suspected
• Payment obligations have not been met
• Athlete safety may be at risk
• Information is being misused
• Legal requirements require restriction
• The Services are being abused
• Continued access may harm Kompete or another user

Where appropriate, we may provide notice or an opportunity to correct the issue.

Serious violations may result in immediate suspension.

Termination does not eliminate obligations that by their nature should survive termination, including intellectual-property rights, payment obligations, disclaimers, limitations of liability, and indemnification.

26. Service Availability and Changes

Kompete continually develops its Services.

We may:

• Modify features
• Remove features
• Change interfaces
• Update testing methodologies
• Update benchmarks
• Modify compatibility
• Perform maintenance
• Introduce new plans
• Discontinue functionality

We will make reasonable efforts to minimize disruption where practical.

However, Kompete does not guarantee uninterrupted or error-free availability.

Scheduled or emergency maintenance, internet connectivity, third-party systems, equipment failures, security incidents, or events outside our reasonable control may temporarily affect availability.

27. Beta and Experimental Features

Certain features may be described as beta, preview, experimental, early access, or similar.

Such features may:

• Change without notice
• Contain errors
• Produce inaccurate results
• Be discontinued
• Have limited support
• Operate differently from final features

You accept the additional uncertainty associated with using experimental functionality.

28. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis.

Except where expressly provided in writing, Kompete disclaims warranties and representations, whether express, implied, statutory, or otherwise, including warranties of:

• Fitness for a particular purpose
• Non-infringement
• Accuracy

• Availability

Kompete does not warrant that:

• The Services will always be uninterrupted
• Testing results will always be error-free
• Benchmark information will always be complete
• AI recommendations will always be accurate
• Training recommendations will achieve particular results
• The Services will satisfy every user's requirements
• Every defect will be corrected
• Every integration or device will remain compatible

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

29. Performance and Sporting Outcomes

Athletic development depends on numerous factors outside Kompete's control.

Kompete does not guarantee:

• Improved athletic performance
• Improved testing results
• Competition results
• Team selection
• Scholarships
• Recruitment
• Professional contracts
• Academic admission
• Athletic eligibility
• Injury prevention
• Specific training results
• Career outcomes

Coaches, athletes, organizations, parents, scouts, and recruiters remain responsible for their own decisions.

30. Limitation of Liability

To the fullest extent permitted by applicable law, Kompete and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services.

This may include losses relating to:

• Lost profits
• Lost opportunities
• Lost athletic opportunities
• Lost recruiting opportunities
• Lost data
• Business interruption
• Reputation
• Training decisions
• Competition outcomes

To the fullest extent permitted by law, Kompete will not be responsible for injury or loss caused by:

• Failure to follow testing instructions
• Unsafe physical activity
• Incorrect equipment setup
• Unauthorized hardware modification
• Misuse of testing systems
• Decisions made solely from automated recommendations
• Conduct of independent users or third parties
• Information incorrectly entered by users
• Circumstances outside Kompete's reasonable control

To the fullest extent permitted by applicable law, Kompete's total aggregate liability arising from or relating to the Services will not exceed the greater of:

(a) the amount paid directly to Kompete by the applicable user during the twelve months immediately preceding the event giving rise to the claim; or

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent legally permitted.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Kompete and its affiliates, officers, directors, employees, contractors, and representatives from claims, liabilities, damages, losses, and reasonable legal expenses arising from or relating to:

• Your unlawful use of the Services
• User Content you provide
• Your infringement of third-party rights
• Your misuse of athlete information
• Fraudulent testing information
• Your unauthorized disclosure of athlete information

If you use Kompete on behalf of an organization, this provision applies to the organization to the extent permitted by applicable law.

This provision does not require a consumer to indemnify Kompete where prohibited by applicable consumer-protection law.

32. Privacy

Your use of Kompete is also governed by the Kompete Privacy Policy.

The Privacy Policy explains how personal information may be collected, used, disclosed, retained, and protected.

Where these Terms and the Privacy Policy address different matters, each document should be interpreted according to its respective purpose.

33. International Use

Kompete may be accessible from multiple countries.

You are responsible for ensuring that your use of the Services complies with laws applicable to you.

Features may vary by jurisdiction.

Kompete may restrict availability of some Services where necessary because of:

• Legal requirements
• Licensing restrictions
• Technical limitations
• Commercial availability
• Regulatory requirements

34. Export and Sanctions Compliance

You may not use, export, re-export, transfer, or make the Services available in violation of applicable export-control, sanctions, or trade laws.

You represent that you are not prohibited from receiving the Services under applicable law.

35. Changes to These Terms

Kompete may update these Terms from time to time to reflect:

The revised Terms will display an updated "Last Updated" date.

36. Governing Law

These Terms will be governed by the laws of:

40. Severability

41. No Waiver

If Kompete does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

A waiver is effective only where expressly provided by an authorized representative.

42. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreement that applies to your use of specific Kompete Services, constitute the agreement between you and Kompete concerning the applicable Services.

They supersede prior understandings concerning the same subject matter except where a separate signed agreement expressly remains effective.

43. Force Majeure

Kompete will not be responsible for delays or failures resulting from circumstances beyond its reasonable control, including:

• Natural disasters
• Severe weather
• Fire
• Flood
• War
• Terrorism
• Civil unrest
• Government action
• Internet outages
• Cloud-service disruptions
• Power outages
• Labour disputes
• Public-health emergencies
• Supply-chain interruptions

This provision applies only to the extent permitted by law.
